Negotiations with publishers seek to redirect subscription funding towards open access publishing fees, with the goal of ensuring open access to publications and research data.
The first chapter presents the context and key principles of Plan S, with a focus on potential strategies to encourage publishers to transition from subscriptions to open access. The second chapter summarizes the current status of negotiations and agreements between scientific institutions and publishers in various European countries and the United States. The third chapter provides a legal analysis of selected transformative agreements from the ESAC Transformative Agreement Registry. The fourth chapter presents three case studies, analyzing the circumstances in Germany, Sweden, and Norway. In the final, fifth chapter, the report offers recommendations concerning the legal aspects of transformative agreements and negotiation procedures within the scientific community.
